Welcome to Emplorix. These Terms of Service ("Terms") govern your access to and use of the Emplorix HR platform and services. By using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Emplorix, you agree to these Terms and our Privacy Policy. If you are using Emplorix on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Emplorix is a human resources management platform that provides:

  • Employee directory and profile management
  • Organizational chart visualization
  • Time off and leave management
  • Performance review tracking
  • HR analytics and reporting
  • Payment and bonus management

3. Account Registration

To use Emplorix, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Upload malicious code or interfere with the service
  • Attempt to gain unauthorized access to our systems
  • Use the service for any illegal or unauthorized purpose
  • Share your account credentials with others
  • Scrape or collect data without authorization
  • Reverse engineer or decompile the software

5. Your Data

5.1 Ownership

You retain ownership of all data you upload to Emplorix ("Your Data"). By using our service, you grant us a license to use Your Data solely to provide and improve our services.

5.2 Data Protection

We implement appropriate security measures to protect Your Data. However, you are responsible for maintaining backups of Your Data and ensuring the accuracy of information you provide.

5.3 Data Export

You may export Your Data at any time through the platform's export features.

6. Intellectual Property

The Emplorix platform, including its design, features, and content, is owned by Emplorix and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

7. Payment Terms

If you subscribe to a paid plan:

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days notice
  • You are responsible for all applicable taxes

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Temporarily suspend service for emergency maintenance
  • Modify or discontinue features with reasonable notice

9. Limitation of Liability

To the maximum extent permitted by law:

  • Emplorix is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to fees paid in the past 12 months
  • We are not responsible for third-party services or integrations

10. Indemnification

You agree to indemnify and hold harmless Emplorix from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Termination

Either party may terminate the agreement:

  • You may cancel your account at any time
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your right to use the service ends immediately
  • We will provide reasonable time to export Your Data

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where Emplorix is registered, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms will be resolved through:

  • Good faith negotiations between the parties
  • Mediation if negotiations fail
  • Binding arbitration as a last resort

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Emplorix
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • No Waiver: Failure to enforce any provision does not waive our right to do so later
  • Assignment: You may not assign these Terms without our consent
